Terms of Service

JomTap is a digital service brand operated by IFES Solutions Sdn. Bhd. (SSM No. 202201007397 (1453094-T)) (“IFES Solutions”, “we”, “us”, or “our”).

By creating an account, ordering an NFC card, or otherwise using JomTap (the “Service”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree to these Terms, you may not access or use the Service.

These Terms apply to all visitors, users, and others who access or use the Service. We may update these Terms from time to time; continued use of the Service after changes means you accept the revised Terms.

You must be at least 13 years old to create an account. If you are under 18, you confirm that you have your parent or legal guardian's permission to use the Service.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately if you suspect unauthorized access. We are not liable for any loss or damage resulting from your failure to safeguard your account.

JomTap offers free and paid subscription plans. Paid plans are billed monthly or yearly via Stripe at the prices listed on our pricing page. By selecting a paid plan, you authorise us (through Stripe) to charge the applicable fees to your payment method on a recurring basis until you cancel. Charges will appear on your statement as IFES Solutions Sdn. Bhd.

You can upgrade your plan at any time; the upgrade takes effect immediately and you will be charged a prorated amount for the remainder of your current billing period. You can downgrade or cancel at any time from your dashboard; the change takes effect at the end of the current billing period and no further charges will be made after that date. We do not provide refunds for any remaining unused portion of a billing period.

We may revise plan pricing with at least 30 days' notice. Continued use after a price change constitutes acceptance of the new pricing.

All subscription prices displayed on our pricing page are exclusive of Service Tax (SST). SST at the applicable rate (currently 8%) will be applied at checkout as required under the Service Tax Act 2018 (Malaysia). A tax invoice will be issued to your registered email address following each payment.

Physical NFC cards are sold as one-time purchases. Standard cards are shipped within 5–10 business days from order confirmation; custom-branded cards may take longer.

All NFC card sales are final. Cards that arrive damaged or defective may be reported within 14 days of delivery for a replacement or remedy. Custom-printed cards are non-refundable unless they arrive damaged or defective. Lost or stolen cards are not eligible for replacement.

You are responsible for the accuracy of your shipping information at checkout.

You retain full ownership of the content you publish to your JomTap profile, including text, images, social links, and contact information (“Your Content”).

By submitting Your Content, you grant JomTap a worldwide, non-exclusive, royalty-free license to host, display, and distribute Your Content solely for the purpose of operating and providing the Service.

You are solely responsible for Your Content. You represent that you have all rights necessary to publish it and that it does not violate any law or third-party right.

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Impersonate any person or entity, or misrepresent your affiliation with anyone.
• Publish content that is unlawful, harassing, defamatory, hateful, sexually explicit, or harmful to minors.
• Distribute spam, malware, or attempt to gain unauthorized access to the Service or other users' accounts.
• Reverse-engineer, scrape, or otherwise misuse our APIs and infrastructure.

We may suspend or terminate accounts that violate these rules, with or without notice.

The Service, including its design, code, branding, and content (excluding Your Content), is owned by IFES Solutions Sdn. Bhd.and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without our written permission.

“JomTap” is a brand name and trade mark of IFES Solutions Sdn. Bhd.. Our logos and brand assets may not be used without prior written consent.

The Service integrates with third-party providers such as Clerk (authentication), Stripe (payments), Cloudinary (media hosting), and Supabase (data storage). Your use of those services is also governed by their own terms and privacy policies.

We are not responsible for the availability or content of any third-party site you link to from your profile.

You may delete your account at any time from the account settings page. We may suspend or terminate your access if you violate these Terms, abuse the Service, or for any other lawful reason.

Upon termination, your right to use the Service ceases immediately. We will retain or delete Your Content in accordance with our Privacy Policy.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

You use the Service at your own risk. We disclaim, to the maximum extent permitted by law, all warranties including merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, IFES Solutions Sdn. Bhd.and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data, or goodwill, arising out of or related to your use of the Service.

Our total aggregate liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) RM 100.

These Terms are governed by the laws of Malaysia, without regard to its conflict of law principles. Any dispute arising under these Terms will be resolved in the courts of Kuala Lumpur, Malaysia, unless otherwise required by applicable law.

We may modify these Terms from time to time. If we make material changes, we will notify you by email or via a notice on the Service prior to the changes taking effect. Continued use of the Service after the effective date constitutes your acceptance of the revised Terms.
